Fair Usage Policy

These rules set out the fair usage limits of HostingRakyat services. All fair limits, as well as the consequences or actions we may take, are stated in this document.

1Website Content

Customers are prohibited from uploading website content that is, and/or is related to:

• Pornography, gambling, racial and religious issues, insults, and public decency.
• Matters that may cause disputes, unrest and violence.
• Material containing copyrighted elements without the owner's permission.
• Material that could be used for matters that disturb or harm others.
• Ponzi schemes, pyramid schemes, fraud, phishing and scams.
• Online transactions/sales of medicines without a valid permit or in breach of the relevant authorities' regulations.
• Other material that does not comply with Malaysian law.
• Material prohibited by the ISP or data centre.

2Use of Hosting Accounts

Customers are prohibited from using hosting accounts to:

• Send bulk email and/or SPAM (further details are given in another clause)
• Install IRC BOTs, PsyBNC and IRC-related processes
• Run web proxies, mail proxies and other types of proxy
• Download files using the hosting facilities, whether through a shell or other means
• Carry out DDoS, port scanning, sniffing and system exploits
• Run BitTorrent or other Peer to Peer applications
• Be used without a registered public domain (spoofing). Hosting accounts whose domain has expired or become available (open for anyone to register) will have their service terminated.
• Store files prohibited under the “Website Content” clause
• Make any use prohibited by the ISP or data centre
• Mine cryptocurrency

For Unlimited Hosting services, the following resource usage policy applies:

• Unlimited Hosting may not be used to provide the following services:
  • Video Streaming
  • Online Storage* (allowed only up to 5GB)
  • File Sharing
  • Image Hosting
• *The definition of “Online Storage” that is ALLOWED within the 5GB limit is the activity of storing files that are not a core component of displaying the website and/or are intended to be downloaded. File types in this category are:
  • .pdf, .doc, .xls and various other file extensions;
  • Log files or other file types generated automatically by the website;
  • Files submitted by visitors, for example files from document submission forms, assignments and e-learning documents, and files for particular information systems
• If your website / information system needs to store files of the types above, we recommend using a Dedicated Hosting service, which offers dedicated space.
• Customers are not allowed to store files larger than 1GB; HostingRakyat therefore reserves the right to delete such files with no guarantee of restoration (from backup). We will send a notification email each time a deletion is made.
• The inode limit in a hosting account is matched to the service plan chosen. Files cannot be added to the hosting account once the number of inodes reaches the plan limit, and this will affect the services within it, including email, websites, databases and so on.
• Weekly backups are only performed for accounts using less than 10 GB of disk space and/or fewer than 75,000 inodes. If the server suffers damage, customers may lose data and HostingRakyat will not be responsible for this.
• Total email usage in a single hosting account may not exceed 10 GB.
• HostingRakyat reserves the right to terminate the service of any hosting account whose space usage exceeds these conditions, giving the customer 30 days to upgrade to a higher service or move their hosting account to another provider. In this case HostingRakyat will refund the remaining balance, calculated pro rata after deducting domain costs and any other costs that may form part of the customer's payment.

3Use of Email Facilities

Customers are prohibited from using email facilities and other facilities capable of sending email to:

• Send SPAM and/or unsolicited email, or knowingly receive either
• Send bulk email for any reason and/or mail bombing
• Send more than 120 emails per hour
• Send material that falls within the prohibited categories in the “Website Content” clause
• Send any type of email prohibited by the ISP or data centre

4Use of Hosting Resources

Customers are prohibited from using hosting resources such as CPU, RAM and storage excessively to the point that it may, or already does, disrupt the service of other customers.

• To maintain the reliability of the hosting service for all customers, hosting accounts that use more than 40% of their allocated CPU and RAM on average will be throttled down to the guaranteed amount of CPU in each service plan.

5Violations

Any violation of these terms may result in:

• Temporary suspension of the service.
• Permanent termination of the service without refund.
• Blocking of the related domain or server.
• HostingRakyat reserves the right to report illegal activity to the authorities in accordance with the laws in force in Malaysia.

6Changes to These Terms

• HostingRakyat reserves the right to change, add to or update this Fair Usage Policy document at any time.
• Any changes will be announced on the official HostingRakyat website and take effect from the date of publication.
• Users are encouraged to review this document from time to time.
